Terms & Conditions

1Definitions & Interpretation

For the purposes of this Agreement:

  • "Vehicl" means any electric two-wheeler, battery, charger, accessory, or related equipment owned by MIVO Electric and made available to the User under this Agreement.

  • “User” / “Renter” means any individual who registers on the MIVO Electric application or website and rents, subscribes to, or operates a Vehicle.

  • “Low-Speed Electric Vehicle” means an electric two-wheeler with a motor power output and maximum speed within the limits prescribed under the Central Motor Vehicles Rules, 1989 that exempt it from mandatory registration and driving-licence requirements.

  • “High-Speed Electric Vehicle” means an electric two-wheeler that exceeds such prescribed limits and is therefore required to be registered, and operated only by a person holding a valid driving licence, under the Motor Vehicles Act, 1988.

  • “Aggregator” has the meaning assigned under Section 2(1A) of the Motor Vehicles Act, 1988, being a digital intermediary or marketplace connecting a passenger or end-user with a driver or vehicle for the purpose of transportation.

  • “Public Place” has the meaning assigned under Section 2(34) of the Motor Vehicles Act, 1988.

  • “KYC” means Know Your Customer verification, including identity, address, and driving-licence verification undertaken by MIVO Electric prior to or during onboarding.

2Acceptance of Agreement

By accessing, booking, renting, subscribing to, unlocking, or operating any vehicle provided by MIVO Electric (“Company”), the customer (“User”) confirms that they have read, understood, and agreed to comply with these Terms & Conditions.

MIVO Electric may revise or update these Terms from time to time in accordance with applicable laws. Updated Terms shall become effective upon publication on the official website or mobile application, and continued use of MIVO Electric services shall constitute acceptance of the revised Terms.

3User Eligibility

Users operating low-speed electric vehicles must be at least 16 years of age and provide valid government-issued identification documents. The verified profile is strictly personal. Under no circumstances shall the User permit any third party to operate the vehicle. Any unauthorized transfer of vehicle control shall result in immediate termination, forfeiture of the security deposit, and reasonable administrative charges of up to ?5,000, depending on the nature of the violation.

Users operating high-speed vehicles must:

  • be at least 18 years of age;

  • possess a valid Indian Driving License suitable for the vehicle category; and

  • complete all KYC verification requirements as prescribed by applicable laws or company policy.

MIVO Electric reserves the right to refuse, suspend, or terminate services if any document, information, or declaration provided by the User is false, misleading, expired, forged, incomplete, or unverifiable.

4Vehicle Ownership

All vehicles, batteries, chargers, accessories, GPS devices, telematics systems, and related equipment shall remain the sole and exclusive property of MIVO Electric at all times.

The User is granted a limited, non-transferable, and temporary right to use the vehicle strictly during the approved rental or subscription period.

Users shall not:

  • sell,

  • sub-rent, transfer, dismantle, tamper with, modify,

  • reverse engineer,

  • or unlawfully retain any MIVO Electric property.

Any unauthorized activity may result in immediate termination, recovery proceedings, penalties, and legal action under applicable Indian laws.

5Security Deposit

MIVO Electric may require a refundable security deposit before vehicle allocation.

Subject to successful inspection and settlement of all pending dues, the refundable amount shall generally be processed within 7 to 15 working days through the original payment method or another lawful mode determined by the Company.

MIVO Electric may deduct reasonable charges relating to:

  • vehicle damage,

  • unpaid rent, traffic challans,

  • battery or charger damage, towing expenses, negligence,

  • missing accessories, cleaning charges, policy violations,

  • or other verified liabilities attributable to the User.

An itemized breakdown of deductions may be provided upon request.

MIVO Electric reserves up to 30 days post-vehicle return to identify latent electronic or battery damage before processing refunds.

6Traffic Violations, Towing, Impoundment & Administrative Levies

The Renter/User shall be solely and exclusively liable for any and all statutory penalties, fines, and e-challans issued by the Delhi Traffic Police or any competent judicial/administrative authority under the Motor Vehicles Act, 1988 (amended) and corresponding Delhi Motor Vehicle Rules, for any traffic, environmental (including Pollution Under Control/PUCC infractions), or regulatory violations recorded during the rental/subsisting period.

In the event the Vehicle is removed, towed, or seized by the enforcement authorities (including the Delhi Traffic Police or municipal corporations) for obstructive, improper, or unauthorized parking under the Delhi Maintenance and Management of Parking Places Rules, the Renter/User shall bear the actual statutory Towing Charges alongside daily Custody/Storage Fees accrued at the designated traffic pound or municipal yard.

Where MIVO Electric is required to intervene, deploy personnel, or attend court/traffic circles to secure the release of an impounded or seized Vehicle, the Renter/User shall immediately indemnify MIVO Electric for all ancillary legal expenses, driver out-of-pocket costs, and loss of revenue due to vehicle downtime. All such amounts, including the Administrative Processing Fee, will be auto-debited from the User's security deposit, failing which MIVO Electric reserves the right to suspend the User's account and initiate legal recovery.

7Rental Payments & Defaults

All rental, subscription, extension, penalty, or usage charges must be paid on or before the applicable due date.

Delayed payments may attract reasonable late payment charges as communicated by MIVO Electric from time to time in accordance with applicable laws.

Delayed rental payments shall attract a daily late fee of ?100 compounding. If a default exceeds 24 hours, the Company reserves the right to remotely immobilize the vehicle. The User waives all rights to claim damages, loss of business earnings, or distress arising out of such safe remote immobilization.

If outstanding dues remain unpaid beyond the permitted grace period, MIVO Electric may:

  • suspend services,

  • restrict access to the vehicle, initiate recovery proceedings,

  • or repossess the vehicle in accordance with law.

Remote immobilization, if applicable, shall only be exercised in a safe and lawful manner and shall never be activated while the vehicle is in motion.

8GPS Tracking & Telematics Consent

MIVO Electric vehicles will be equipped with GPS tracking, IoT devices, telematics systems, geo-fencing technology, remote diagnostics, and anti-theft systems for operational, safety, compliance, and security purposes.

The User shall not tamper with, disable, damage, or interfere with any tracking or electronic system installed in the vehicle. Any such act may result in penalties, repossession, suspension of services, or legal action.

9Battery & Charging Policy

Users shall use only approved batteries, chargers, charging stations, or swapping systems authorized by MIVO Electric.

Operating the vehicle through water-logged areas where water levels exceed the wheel hub or floorboard line is strictly prohibited. Any resultant short-circuits, thermal runaways, or degradation of lithium-ion cells shall be treated as gross negligence, making the User 100% liable for the full replacement cost of the battery and drivetrain assembly.

The User may be held liable for damages caused due to theft, negligence, misuse, unauthorized alterations, or violation of safety instructions.

Important: Lithium-ion batteries carry inherent risks of thermal runaway if damaged, exposed to water, or charged using non-approved equipment. Always use MIVO Electric-authorized charging infrastructure and report any unusual heat, swelling, or odour from the battery immediately.

10Rider Responsibilities & Road Safety Compliance

The User shall operate the vehicle responsibly and in compliance with all applicable traffic laws, safety regulations, and government requirements.

The User shall not exceed the manufacturer's specified maximum carrying capacity (Payload Limit). The User is strictly prohibited from taking the vehicle to independent local roadside mechanics or third-party garages. All maintenance, repairs, or part replacements must exclusively be executed via authorized MIVO Electric service hubs.

In addition, and without limiting the generality of the foregoing, the User shall at all times comply with:

  • Speed limits and lane discipline as prescribed by the traffic authority for the relevant road or zone;

  • The prohibition on driving under the influence of alcohol or drugs under Section 185 of the Motor Vehicles Act, 1988;

  • The prohibition on use of a mobile phone while driving, except via an approved hands-free device, consistent with Section 184 (driving dangerously);

  • The pillion-rider limit of one additional person, seated on a duly secured pillion seat, under Section 128 of the Motor Vehicles Act, 1988;

  • Mandatory helmet use for the rider (and, where applicable, the pillion rider) under Section 129, subject to the statutory exemption for turban-wearing Sikh riders.

11Helmets, Protective Equipment & Assumption of Risk

The User acknowledges that operating a two-wheeler, including a low-speed electric vehicle, carries inherent risks of injury arising from traffic, road conditions, weather, mechanical failure, or the conduct of third parties, and that these risks cannot be eliminated entirely by MIVO Electric.

The User shall wear a protective helmet conforming to applicable Bureau of Indian Standards (BIS) specifications at all times while operating a MIVO Electric vehicle, regardless of whether the vehicle is classified as a low-speed or high-speed electric vehicle, except where a low-speed vehicle is statutorily exempt and the User nonetheless assumes full responsibility for choosing to ride without one.

By accepting these Terms, the User voluntarily assumes the risks associated with two-wheeler operation, including the increased risk of head injury, permanent disability, or death from not wearing a helmet, and agrees that MIVO Electric shall not be liable for injury, loss, or damage arising from the User's choice not to wear a helmet or other protective equipment, except to the extent such liability cannot lawfully be excluded under Indian law.

12Insurance

MIVO Electric will, where required by law, maintain a valid third-party insurance policy in respect of each registered (high-speed) Vehicle, in accordance with Chapter XI of the Motor Vehicles Act, 1988.

Such third-party insurance covers statutory third-party liability only. It does not, unless separately purchased and explicitly stated, cover the User's personal injury, loss of personal belongings, or comprehensive damage to the Vehicle arising from the User's own negligence.

Users are strongly encouraged to assess and obtain their own personal accident or health insurance cover. MIVO Electric may, at its discretion, offer optional insurance add-ons, the terms of which will be governed by the respective insurer's policy wording and not by this Agreement.

Insurance is Optional and at Rider's Cost: MIVO Electric does not provide, arrange, or subsidize any personal accident, health, or comprehensive vehicle insurance for the User as part of the standard rental or subscription fee. Any User who wishes to obtain personal accident, health, or comprehensive coverage must independently purchase such insurance, at their own cost, from an insurer of their choice, or through any optional add-on separately offered and explicitly charged for by MIVO Electric. MIVO Electric shall not be liable for any personal injury, medical expense, disability, death, or loss of personal belongings suffered by the User arising from the use of the Vehicle on the road, except to the extent such loss or injury is directly and proximately caused by MIVO Electric's proven negligence, a vehicle defect attributable to MIVO Electric, or any liability that cannot lawfully be excluded under Indian law.

13Accidents, Theft & Damages

In the event of any accident, theft, fire, loss, or damage involving the vehicle, the User must notify MIVO Electric as soon as reasonably possible and preferably within one hour of the incident.

Where required by law or insurer instructions, the User shall cooperate in filing an FIR, police complaint, insurance documentation, or investigation.

Insurance claims shall remain subject to insurer approval, policy terms, investigation, and applicable deductibles.

The User may be held liable for damages arising due to:

  • drunk driving,

  • rash or negligent driving, overspeeding, unauthorized use,

  • policy violations, criminal conduct,

  • or breach of these Terms.

14Roadside Breakdown, Mishap & Total Rider Responsibility

In the event of a vehicle breakdown, mechanical fault, or any other roadside issue, the User must immediately notify MIVO Electric through the app or support helpline and shall remain at the location for a minimum of one hour to await MIVO Electric's roadside assistance or repair team, unless personal safety requires the User to relocate to a nearby safe area, in which case the User must inform MIVO Electric of the new location.

If the User leaves the location before MIVO Electric's roadside assistance or repair team arrives and before the one-hour waiting period has elapsed, and the vehicle is lost, stolen, damaged, or otherwise suffers any major loss in the User's absence, the User shall be solely and entirely responsible for such loss, including the full cost of repair or replacement of the vehicle and any associated charges.

Important: Any accident, injury, loss, or mishap of any kind that occurs on the road while operating a MIVO Electric vehicle is entirely and solely the User's own responsibility. MIVO Electric shall not be liable or responsible in any way whatsoever for any road accident, injury, death, loss, or mishap, regardless of cause or circumstance. The User accepts and assumes this responsibility fully by accepting these Terms.

15Vehicle Recovery & Repossession

If a vehicle is not returned within 12 hours of the expiration of the subscription period, or if the GPS tracking device is disconnected and the User is unreachable for a consecutive 24 hours, it shall be treated as an intent to steal. MIVO Electric shall immediately initiate criminal proceedings under Section 316 of the Bharatiya Nyaya Sanhita, 2023 (or applicable Criminal Breach of Trust laws), and flash the vehicle details to law enforcement authorities.

If the User flees with the vehicle, causes any damage or loss to the vehicle, or the vehicle is stolen while in the User's custody, the User shall be solely responsible for the full amount of any fine, penalty, repair cost, or replacement cost arising therefrom. For the purpose of locating the User, recovering the vehicle, or investigating any such incident, MIVO Electric reserves the right to contact the User's emergency contacts, references, or other persons known to the User as provided during onboarding or KYC verification.

16Prohibited Activities

Users shall not:

  • sub-rent vehicles,

  • use vehicles for racing or stunts, transport illegal goods,

  • engage in unlawful activities,

  • operate vehicles outside permitted operational zones without authorization, or

  • tamper with vehicle branding, software, wiring, batteries, or electronics.

Violations may result in suspension, penalties, damage recovery, termination of services, and legal action.

17Aggregator & Platform Compliance

Where MIVO Electric vehicles are used by Users who are also registered as delivery or gig-work partners with third-party platforms (such as food delivery, e-commerce logistics, or ride-hailing aggregators), the User remains solely responsible for ensuring that such use complies with the terms of the relevant aggregator and with all applicable licensing conditions imposed on aggregators operating in Delhi NCR.

MIVO Electric is not a transportation aggregator and does not itself connect Users with passengers for hire or reward. Nothing in this Agreement shall be construed as MIVO Electric assuming the regulatory obligations of an aggregator under the Motor Vehicles (Amendment) Act, 2019, unless and until MIVO Electric separately obtains and operates under an aggregator licence.

18Data Protection & Privacy

MIVO Electric may collect and process personal information including:

  • KYC documents, GPS data,

  • ride history, payment records,

  • technical information,

  • and device-related information

for purposes relating to:

  • operations, customer support, fraud prevention,

  • regulatory compliance, safety monitoring, fleet management, analytics,

  • and lawful business operations.

Such data shall be processed in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, and the MIVO Electric Privacy Policy.

Users may contact MIVO Electric regarding privacy-related concerns through official support channels.

19Consumer Grievance Redressal

MIVO Electric has appointed a Grievance Officer to receive and address complaints relating to the quality of services, billing disputes, security deposit deductions, or any other deficiency in service as defined under Section 2(11) of the Consumer Protection Act, 2019.

MIVO Electric shall endeavour to acknowledge a grievance within 48 hours and resolve it within 30 days of receipt, in line with prevailing consumer protection norms.

If a User remains dissatisfied with the resolution provided, the User may approach the appropriate District, State, or National Consumer Disputes Redressal Commission having jurisdiction, without prejudice to the dispute resolution mechanism set out in Clause 24 below.

20Suspension & Termination

MIVO Electric reserves the right to immediately suspend, restrict, or terminate a User's access to the services, application, website, and any assigned vehicle or equipment, based on reasonable grounds and circumstances applicable under law and without prior notice or liability, in the event of any policy violation, fraudulent or abusive conduct, non-payment, or any other act, omission, or operational risk that MIVO Electric deems detrimental to its business, property, safety standards, or legal compliance.

The termination of this Agreement or suspension of services shall be entirely without prejudice to any outstanding financial liabilities, accrued payment obligations, damages, or legal remedies available to MIVO Electric prior to or arising from such termination.

21Limitation of Liability

To the maximum extent permitted under applicable law, MIVO Electric shall not be liable for:

  • indirect or consequential losses, loss of profits or income,

  • loss of personal belongings, service interruptions, charging delays,

  • network failures,

  • or events beyond the reasonable control of the Company.

Nothing in these Terms shall exclude liability where such exclusion is prohibited under Indian law.

MIVO Electric shall not be held liable for any loss of commercial earnings, contractual delivery SLA penalties, delivery account suspensions, or algorithmic de-prioritization suffered by the User due to unexpected vehicle breakdowns, mechanical component failures, battery swapping delays, or software/app downtime.

22Indemnity

The User agrees to indemnify and hold harmless MIVO Electric, its directors, employees, agents, and affiliates against losses, damages, liabilities, claims, penalties, or legal expenses arising out of the User's breach of this Agreement, negligent or unlawful operation of the Vehicle, or violation of applicable law.

23Force Majeure

MIVO Electric shall not be held liable for delays, interruptions, or failure in performance caused by events beyond reasonable control including natural disasters, floods, riots, strikes, pandemics, governmental restrictions, power failures, cyber incidents, supply shortages, or technical disruptions.

24Dispute Resolution & Jurisdiction

The parties shall attempt to resolve disputes amicably in good faith.

Failing such resolution, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurugram, Haryana, and proceedings shall be conducted in English.

Subject to applicable consumer protection laws, courts located in Gurugram, Haryana shall have jurisdiction over matters arising from these Terms.

25Severability

If any provision of this Agreement is declared void or unenforceable by a court of competent jurisdiction, such provision will be severed from this Agreement, and the balance of this Agreement will remain in full force and effect.

26Waiver

Failure by MIVO Electric to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

27Electronic Consent

Use of the MIVO Electric application, website, OTP verification systems, digital signatures, online payments, electronic communication systems, or vehicle unlocking systems shall constitute valid electronic acceptance of these Terms in accordance with the Information Technology Act, 2000 and other applicable Indian laws.

28Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, including but not limited to the Motor Vehicles Act, 1988, the Indian Contract Act, 1872, the Digital Personal Data Protection Act, 2023, the Bharatiya Nyaya Sanhita, 2023, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Arbitration and Conciliation Act, 1996, without regard to conflict-of-law principles.

Rider / Driver Agreement

1Parties & Nature of Relationship

This Agreement records the relationship between MIVO Electric as the owner/lessor of the Vehicle and the Rider as an independent individual who rents, subscribes to, or is allotted a MIVO Electric electric two-wheeler for personal use or for use in connection with third-party gig/delivery work.

Nothing in this Agreement creates an employer-employee relationship, partnership, agency, or joint venture between MIVO Electric and the Rider. The Rider operates as an independent user of MIVO Electric's rental/subscription services and, where applicable, as an independent contractor or micro-entrepreneur in respect of any third-party platform the Rider separately works with.

2Eligibility & Document Verification

By signing this Agreement, the Rider confirms and undertakes that:

I am at least 18 years of age (or 16 years of age, where exclusively operating a low-speed electric vehicle exempt under the Central Motor Vehicles Rules, 1989).

I hold a valid Indian Driving Licence authorising me to operate the class of vehicle allotted to me, where the vehicle requires one.

I have submitted true, accurate, and current KYC documents, including identity proof, address proof, photograph, PAN, and bank details where required, and I will inform MIVO Electric immediately of any change.

I understand that MIVO Electric may independently verify any document submitted, including through third-party verification agencies, and may suspend or terminate my access if any document is found false, forged, expired, or unverifiable.

I do not have any pending criminal proceedings, suspension, or disqualification of my driving licence that would make me ineligible to operate a motor vehicle under the Motor Vehicles Act, 1988.

Legal Basis: Sections 3 and 4, Motor Vehicles Act, 1988 (licence and minimum-age requirements); Section 19 (disqualification from holding a driving licence).

3Vehicle Handover & Inspection Acknowledgement

The Rider acknowledges that, at the time of vehicle handover:

I have inspected the Vehicle, including its body, tyres, brakes, lights, mirrors, battery, and accessories, and confirm it is in good and roadworthy condition save for any defects noted in writing at handover.

I have received one helmet (and a second, where a pillion seat is provided) and confirm both are in usable condition.

I have been shown how to operate the Vehicle's swap/charging mechanism, GPS/telematics unit, and emergency contact feature on the MIVO Electric app.

I will report any pre-existing damage, missing part, or malfunction within 30 minutes of handover, failing which the Vehicle shall be deemed accepted in good condition, as set out in Clause 5 of the Terms & Conditions.

4Rider's Operational Undertakings

The Rider undertakes to:

  • Operate the Vehicle personally and not permit any other individual to ride, drive, or otherwise operate it.

  • Wear a BIS-conforming helmet at all times while riding, and ensure any pillion passenger does the same, subject to the statutory exemption for turban-wearing Sikh riders.

  • Never operate the Vehicle under the influence of alcohol, drugs, or any intoxicating substance.

  • Comply with all applicable speed limits, traffic signals, lane discipline, and one-way restrictions.

  • Carry no more than one pillion rider, seated on a duly secured pillion seat.

  • Not use a handheld mobile phone while riding, except through an approved hands-free device.

  • Use only MIVO Electric-authorized charging/battery-swap infrastructure, and never submerge the Vehicle in water above the wheel-hub/floorboard line.

  • Not use the Vehicle for racing, stunts, transport of illegal goods, or any unlawful purpose.

  • Route all repairs, servicing, and part replacements exclusively through MIVO Electric-authorized service hubs.

  • Immediately report any accident, theft, fire, mechanical failure, or safety incident to MIVO Electric and, where required, to the police, within the timelines set out in the Terms & Conditions.

  • Return the Vehicle, battery, charger, and all accessories at the end of the rental/subscription period in the condition received, ordinary wear and tear excepted.

5Financial Undertakings

The Rider agrees to pay all rental, subscription, late, damage, towing, impoundment, and administrative charges as set out in the Terms & Conditions, and authorizes MIVO Electric to deduct such amounts from the security deposit or any other payment instrument on file. The Rider further agrees that unauthorized transfer of vehicle control under Clause 3 of the Terms & Conditions attracts reasonable administrative charges of up to ?5,000, depending on the nature of the violation, in addition to forfeiture of the security deposit.

6Data Consent

The Rider consents to MIVO Electric's collection and processing of personal data, KYC documents, GPS/location data, ride history, and payment information, in accordance with the MIVO Electric Privacy Policy and the Digital Personal Data Protection Act, 2023, for the purposes described therein, including fleet safety, fraud prevention, and regulatory compliance.

7Insurance Acknowledgement

The Rider acknowledges that MIVO Electric maintains statutory third-party insurance for registered (high-speed) vehicles only, which does not cover the Rider's personal injury or belongings, and that the Rider is solely responsible for obtaining personal accident or health insurance if desired. Where the Rider is enrolled under any accidental cover scheme offered by MIVO Electric or its insurance partner (where applicable), the terms of that scheme are governed separately by the insurer's policy wording.

I understand that MIVO Electric does not provide me with personal accident, health, or comprehensive insurance as part of my rental/subscription. I understand that if I want such coverage, I must purchase it myself, at my own cost, from an insurer of my choice.

I acknowledge that any road accident, injury, medical expense, loss, or mishap of any kind that I suffer while riding is entirely and solely my own responsibility, and MIVO Electric shall not be liable or responsible in any way whatsoever for any road accident, injury, death, loss, or mishap, regardless of cause or circumstance. I accept and assume this responsibility fully by accepting this Agreement.

I confirm I have been given the opportunity to purchase optional insurance (where offered by MIVO Electric) before accepting this Agreement, and my decision to accept or decline it was made voluntarily.

8Roadside Breakdown & Vehicle Recovery Undertakings

In the event of a vehicle breakdown, mechanical fault, or any other roadside issue, I undertake to immediately notify MIVO Electric through the app or support helpline and to remain at the location for a minimum of one hour to await MIVO Electric's roadside assistance or repair team, unless personal safety requires me to relocate to a nearby safe area, in which case I will inform MIVO Electric of my new location.

I understand that if I leave the location before MIVO Electric's roadside assistance or repair team arrives and before the one-hour waiting period has elapsed, and the Vehicle is lost, stolen, damaged, or otherwise suffers any major loss in my absence, I shall be solely and entirely responsible for such loss, including the full cost of repair or replacement of the Vehicle and any associated charges.

I understand that if I flee with the Vehicle, cause any damage or loss to it, or it is stolen while in my custody, I shall be solely responsible for the full amount of any fine, penalty, repair cost, or replacement cost arising therefrom.

I understand and consent that, for the purpose of locating me, recovering the Vehicle, or investigating any such incident, MIVO Electric may contact my emergency contacts, references, or other persons known to me as provided during onboarding or KYC verification.

9Consequences of Breach

The Rider acknowledges that breach of this Agreement may result in any or all of the following, as applicable and proportionate to the breach: a warning, financial penalty, suspension of account, remote immobilization of the Vehicle, forfeiture of the security deposit, repossession of the Vehicle, termination of services, civil recovery proceedings, and/or referral to law enforcement authorities, in accordance with the Terms & Conditions.

10Acknowledgement & Signature

I confirm that I have read, understood, and voluntarily agree to be bound by this Rider/Driver Agreement, the MIVO Electric Terms & Conditions, and the MIVO Electric Privacy Policy. I understand that clicking “I Agree”, completing OTP verification, or accepting this Agreement on the MIVO Electric app constitutes a valid electronic signature under the Information Technology Act, 2000.

MIVO Electric (“MIVO Electric”, “Company”, “we”, “our”, or “us”) operates an electric two-wheeler mobility platform offering vehicle rental, subscription, battery-swapping infrastructure, and related services across India. We are committed to protecting your privacy and handling your personal data lawfully, fairly, and transparently.

This Privacy Policy explains how we collect, use, process, store, disclose, and protect your personal information when you access or use our website, mobile application, electric vehicles, battery-swapping network, charging infrastructure, customer support services, or any related services offered by MIVO Electric (collectively, the “Services”).

By accessing or using MIVO Electric Services, registering an account, submitting your information, or operating any vehicle or platform provided by MIVO Electric, you acknowledge that you have read and understood this Privacy Policy and consent to the collection and processing of your personal data in accordance with applicable Indian law, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and rules framed thereunder.

3Information We Collect

MIVO Electric may collect the following categories of information:

BIdentity & Driving Eligibility Verification (KYC)

As part of mandatory KYC verification, MIVO Electric requires every User to submit identity and driving-eligibility documents including:

  • Aadhaar Card (for identity and address verification, as permitted under applicable law)

  • Driving Licence valid for the class of two-wheeler being operated

  • PAN Card

  • Government-issued identification documents

  • Police verification records (where applicable)

Where Aadhaar is collected, MIVO Electric will, where required by the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 and rules framed thereunder, obtain it on a voluntary basis with the User's explicit consent, accept e-KYC or offline Aadhaar XML/QR verification in lieu of the physical document, and offer an alternative valid government-issued identity document to any User who does not wish to furnish Aadhaar, so that submission of Aadhaar is never the sole means of completing KYC.

MIVO Electric processes personal data only for purposes that are lawful, necessary, and reasonably connected with our Services, consistent with the purpose-limitation principle under the DPDP Act, 2023.

6Lawful Basis & Consent (DPDP Act, 2023)

As a Data Fiduciary under the DPDP Act, 2023, MIVO Electric processes personal data only on the basis of free, informed, specific, and unambiguous consent, or another lawful basis recognised under the Act, such as a legitimate use specified in Section 7 (for example, compliance with a legal obligation or a medical emergency).

By using MIVO Electric Services or submitting personal information, you consent to the collection, storage, use, and processing of your information in accordance with this Privacy Policy and applicable Indian law.

You may withdraw consent at any time by contacting MIVO Electric using the details provided in Section 21. Withdrawal of consent may affect the availability or functionality of certain Services, and will not affect the lawfulness of processing carried out before withdrawal.

7GPS Tracking, Telematics & Vehicle Monitoring

MIVO Electric vehicles may contain GPS tracking systems, telematics devices, IoT systems, and remote monitoring technologies.

Location and operational data may be collected for:

  • Rider and vehicle safety

  • Fleet management

  • Route optimisation

  • Theft prevention and vehicle recovery

  • Fraud detection

  • Operational compliance

  • Battery diagnostics and maintenance

MIVO Electric may remotely disable or immobilise vehicles where reasonably necessary for safety, theft prevention, recovery, non-payment, unauthorised usage, or legal compliance.

8Rider Eligibility & Compliance (Motor Vehicles Act, 1988)

MIVO Electric operates electric two-wheelers that are made available to riders under rental, subscription, or fleet arrangements. Use of these vehicles is subject to the Motor Vehicles Act, 1988, the Central Motor Vehicles Rules, 1989, and applicable state transport regulations. MIVO Electric processes certain personal data specifically to meet these obligations:

  • Minimum age verification — no individual below 18 years of age may operate a motor vehicle on a public road, as prescribed under Section 4 of the Motor Vehicles Act, 1988.

  • Valid driving licence — every rider must hold a driving licence authorising operation of the relevant class of two-wheeler, as required under Section 3.

  • Helmet compliance — riders are required to wear a properly fastened helmet conforming to applicable safety standards while operating the vehicle, in accordance with Section 129 (subject to the statutory exemption for turban-wearing Sikh riders).

  • Pillion rider safety — a MIVO Electric two-wheeler may carry no more than one pillion rider, seated on a duly secured pillion seat, consistent with Section 128.

  • Registration and fitness — MIVO Electric vehicles are registered and maintained in accordance with Chapter IV of the Act; vehicle identification and fitness records may be linked to your ride data for safety and compliance purposes.

  • Aggregator and operational compliance — where MIVO Electric or its partners operate under any state aggregator licensing framework introduced following the Motor Vehicles (Amendment) Act, 2019, relevant ride and rider data may be retained and shared with regulators as required by that framework.

Riders are solely responsible for complying with all applicable traffic laws, including speed limits, signalling rules, and prohibitions on driving under the influence of alcohol or drugs. MIVO Electric may suspend or terminate access to the Services for any rider found to be in violation of these requirements, and may share relevant data with law enforcement authorities where legally required.

9Sharing & Disclosure of Information

MIVO Electric does not sell personal information to third parties.

However, personal data may be shared with:

  • Payment gateway providers

  • Cloud hosting providers

  • KYC and verification agencies

  • Insurance companies

  • Customer support vendors

  • Analytics and technology providers

  • Logistics and operational partners

  • Government authorities, regulators, courts, traffic police, or law enforcement agencies where legally required

In the event of a merger, acquisition, restructuring, financing, or transfer of business assets, personal information may be transferred as part of the transaction, subject to applicable legal safeguards and continued protection under this Policy or an equivalent standard.

10Cross-Border Data Transfers

MIVO Electric may use third-party infrastructure or cloud service providers located outside India. As a result, certain personal information may be processed or stored on servers located in other jurisdictions.

MIVO Electric takes reasonable measures to ensure that such transfers are protected through appropriate contractual, technical, and organisational safeguards in accordance with applicable law, including Section 16 of the DPDP Act, 2023, which permits cross-border transfer of personal data except to countries restricted by the Central Government by notification.

11Data Security

MIVO Electric implements reasonable technical, administrative, and organisational safeguards to protect personal information against unauthorised access, misuse, disclosure, alteration, loss, or destruction.

Security measures may include:

  • Encrypted communications

  • Restricted access controls

  • Secure cloud infrastructure

  • Authentication mechanisms

  • Monitoring and security reviews

Despite reasonable safeguards, no digital platform or internet transmission can be guaranteed to be completely secure.

Users are responsible for maintaining the confidentiality of their passwords, OTPs, login credentials, and devices.

12Data Retention

MIVO Electric retains personal data only for as long as necessary for:

  • Providing the Services

  • Legal compliance, including Motor Vehicles Act recordkeeping requirements

  • Fraud prevention

  • Dispute resolution

  • Operational recordkeeping

  • Taxation and accounting requirements

  • Enforcement of agreements

Upon closure of an account or withdrawal of consent, MIVO Electric will erase, anonymise, or securely archive personal information unless retention is required under applicable law or for legitimate business purposes, consistent with the storage-limitation principle under Section 8(7) of the DPDP Act, 2023.

13Your Rights as a Data Principal

Under the DPDP Act, 2023, you, as a Data Principal, may have the right to:

  • Obtain a summary of personal data processed and the processing activities undertaken (right to access information)

  • Request correction, completion, or updating of inaccurate or misleading personal data

  • Request erasure of personal data that is no longer necessary for the purpose it was collected

  • Withdraw consent at any time

  • Object to or restrict certain processing activities

  • Nominate another individual to exercise these rights on your behalf in the event of death or incapacity

  • Have readily available means to register a grievance with MIVO Electric, and thereafter, if unresolved, with the Data Protection Board of India

Requests may be submitted through the contact details provided in Section 21. MIVO Electric may require identity verification before processing requests.

14Cookies & Analytics

MIVO Electric websites and applications may use cookies, SDKs, analytics tools, and similar technologies to:

  • Improve platform functionality

  • Understand user behaviour

  • Enhance user experience

  • Measure performance

  • Personalise content

  • Maintain security

Users may manage cookie preferences through browser or device settings.

15Third-Party Services

MIVO Electric Services may contain links or integrations with third-party platforms, payment gateways, mapping services, or external websites.

MIVO Electric is not responsible for the privacy practices, content, or security standards of third-party services. Users are encouraged to review the privacy policies of such external services independently.

16Children's Privacy

MIVO Electric Services are not intended for individuals below 18 years of age, consistent with the minimum driving-age requirement under Section 4 of the Motor Vehicles Act, 1988, or any other minimum age prescribed under applicable law.

MIVO Electric does not knowingly collect personal information from children without verifiable parental or lawful guardian consent, as required under Section 9 of the DPDP Act, 2023, except where independently authorised by law.

17Marketing Communications

Users may receive promotional communications, offers, updates, or marketing messages from MIVO Electric.

Users may opt out of promotional communications at any time using the unsubscribe option or by contacting MIVO Electric directly.

Operational or service-related communications may still be sent where necessary.

18Breach Notification

In the event of a personal data breach, MIVO Electric will take prompt remedial action and will notify the Data Protection Board of India and affected Data Principals as required under Section 8(6) of the DPDP Act, 2023 and the Digital Personal Data Protection Rules, 2025, including the nature, extent, and likely impact of the breach and the measures taken to mitigate it.

19Grievance Redressal

MIVO Electric has appointed a Grievance Officer / Data Protection Officer to address privacy-related concerns and complaints. MIVO Electric will endeavour to acknowledge and resolve grievances within the timelines prescribed under applicable law.

If you remain dissatisfied with the resolution provided, you may escalate your grievance to the Data Protection Board of India, constituted under Chapter V of the DPDP Act, 2023.

20Changes to this Privacy Policy

MIVO Electric reserves the right to modify or update this Privacy Policy at any time to reflect operational, technological, legal, or regulatory changes.

Updated versions will be published on official MIVO Electric platforms with a revised effective date.

Continued use of the Services after such updates constitutes acceptance of the revised Privacy Policy.

Cancellation & Refund Policy

1Booking Cancellation by the User

Where a User cancels a confirmed booking before vehicle handover, the following cancellation charges apply:

Time of Cancellation Refund / Forfeiture
More than 24 hours before scheduled pickup Full refund, less payment-gateway charges (if any)
Between 24 hours and 4 hours before pickup 50% forfeited; 50% refunded
Less than 4 hours before pickup, or no-show 100% forfeited; no refund

2Cancellation by MIVO Electric

If MIVO Electric cancels a confirmed booking due to non-availability of a vehicle, or for any operational reason attributable to the Company, a full refund of the booking/advance amount shall be processed within 7 working days, irrespective of the cancellation-charge schedule in Clause 1.

MIVO Electric may also decline or cancel a booking where KYC verification fails, eligibility criteria are not met, or fraud is suspected; in such cases, MIVO Electric will inform the User of the reason and process any eligible refund in accordance with this Policy.

3Subscription Cancellation

A User cancelling an active monthly or periodic subscription before its term ends is entitled to a refund of any unused, pre-paid subscription fees for the remaining period, less:

  • any cancellation charge disclosed to the User at the time of subscribing;

  • outstanding dues, including rent, traffic challans, damage charges, or penalties under the Terms & Conditions; and

  • any amount already utilized or consumed under the subscription (for example, distance- or day-based plans already availed).

The security deposit (where applicable) will be processed for refund separately in accordance with Clause 5 of the Terms & Conditions, after final inspection of the vehicle.

4Cases Where No Refund Applies

No refund shall be due in the following circumstances:

  • Early voluntary drop-off or return of the vehicle before the agreed rental/subscription period ends.

  • Part-used rental periods (for example, an hourly or daily plan used partially).

  • Booking cancelled by MIVO Electric due to the User's breach of the Terms & Conditions, including false KYC information, safety violations, or fraud.

  • Amounts already consumed as ride charges, swap/charging fees, or platform usage fees prior to cancellation.

  • Payments made through non-refundable instruments (such as certain promotional vouchers or cash-on-pickup bookings, where specifically disclosed as non-refundable at the time of payment).

  • Cases where the vehicle is lost, stolen, damaged, or abandoned due to the User's own absence, breach, or negligence (including failure to wait for roadside assistance as required under the Terms & Conditions); in such cases, no refund of the security deposit or any subscription fee shall be due, and the User shall remain liable for the full cost of repair, replacement, or any associated fine as set out in the Terms & Conditions.

5Security Deposit Refunds

Security deposit refunds are governed by Clause 5 of the MIVO Electric Terms & Conditions and are processed within 7 to 15 working days of vehicle return, subject to final inspection and settlement of dues. MIVO Electric reserves up to 30 days post-return to identify latent battery or electronic damage before finalizing the refund, in which case any verified deduction will be itemized on request.

6Refund Timeline & Mode

All eligible refunds under this Policy will be processed to the User's original payment method (UPI, card, net banking, or wallet, as applicable) or another lawful mode determined by MIVO Electric, within 7 to 15 working days of approval. The actual time for the amount to reflect in the User's account may vary depending on the User's bank or payment provider, and MIVO Electric shall not be liable for such delays beyond its control.

7How to Request a Cancellation or Refund

Users may request a cancellation or raise a refund query through:

  • The “My Bookings” or “My Subscription” section of the MIVO Electric app;

  • Calling the MIVO Electric support helpline with the booking/subscription ID; or

  • The MIVO Electric support helpline during operational hours.

MIVO Electric will acknowledge a refund request within 48 hours and resolve it within 30 days, in line with the grievance redressal timelines under the Terms & Conditions. Users dissatisfied with the outcome may escalate the matter to the appropriate Consumer Disputes Redressal Commission.

8Policy Updates

MIVO Electric may revise this Policy from time to time. The version in effect at the time of booking shall apply to that booking; any revision will not retroactively alter cancellation terms already agreed for an existing confirmed booking or subscription.
